Terms and Conditions of Booking

These Terms and Conditions ("Agreement") govern the services provided by Always Iceland, a registered tour operator in Iceland, and your (“Customer”, “you”, “your”) booking of any tours or services offered on our website or through direct communication.
By booking a tour with Always Iceland, you agree to these Terms and Conditions in full.

2. Booking and Payment
  • All bookings are confirmed only upon receipt of full or partial payment as specified on our website or by email.
  • Bookings can be made through our website, email, or authorised agents.
  • A booking confirmation will be sent via email once payment is processed.
  • The person making the booking must be at least 18 years old and is responsible for providing accurate information and securing payment.
     
3. Prices and Currency
  • All prices are listed in Icelandic króna (ISK) and include VAT (Value Added Tax) in accordance with Icelandic tax laws.
  • Prices are subject to change without prior notice, but once a booking is confirmed, the agreed price will not change.
  • Prices generally include transportation, guiding services, and any listed inclusions (e.g., entry fees, meals, accommodations). Please refer to each tour description for specific inclusions and exclusions.
     
4. Cancellations and Refund Policy
By the Customer:
  • Cancellation requests must be submitted in writing to [insert email].
  • Standard cancellation terms (unless otherwise stated in your booking):
    • More than 7 days before the tour: 90% refund
    • 3–7 days before the tour: 50% refund
    • Less than 72 hours: no refund
  • Refunds will be issued using the original payment method and may take 5–10 business days to process.
  • No refunds are given for no-shows or unused services.
     
By Always Iceland:
  • We reserve the right to cancel or modify a tour due to weather conditions, safety concerns, force majeure (including volcanic activity), or insufficient participation.
  • In such cases, we will offer:
    • A rescheduled date (subject to availability), or
    • An alternative tour of equal value, or
    • A full refund.
  • We are not liable for any other costs you may incur (e.g., flights, hotels).
     
5. Customer Responsibilities
  • It is your responsibility to ensure you are in suitable physical condition for the tour and that you arrive at the designated meeting point on time.
  • You must inform us of any health issues, allergies, or special needs when booking.
  • You are responsible for holding valid travel documents, visas (if applicable), and complying with Icelandic laws and customs regulations.
     
6. Travel Insurance
  • Travel insurance is highly recommended and is your responsibility to arrange.
  • Always Iceland does not provide travel or medical insurance.
  • We are not liable for costs due to personal illness, injury, flight cancellations, missed connections, or lost luggage.
     
7. Liability and Disclaimer
  • Always Iceland’s liability is limited to the value of the booked service.
  • We are not responsible for:
    • Third-party service providers (e.g., accommodations, transport beyond our control).
    • Delays, accidents, or injuries caused by weather, natural disasters, or acts of God.
    • Loss or damage to personal belongings.
  • Our tours may involve risks associated with outdoor activities, such as hiking, glacier walks, or rough terrain. You participate at your own risk.
     
8. Changes to Itinerary
  • Itineraries may be adjusted due to weather, road conditions, or unforeseen circumstances.
  • Always Iceland reserves the right to make minor changes without notice to ensure your safety or improve the experience.
     
9. Force Majeure
Always Iceland is not responsible for failure to perform due to causes beyond our reasonable control, including natural disasters, strikes, wars, pandemics, government restrictions, or extreme weather conditions.

10. Photographs and Media
  • During tours, photographs and videos may be taken for marketing purposes. By participating, you grant Always Iceland the right to use these materials unless you inform us otherwise in writing prior to the tour.
  • Customers may take personal photos but may not use media from the tour for commercial purposes without permission.
     
11. Data Protection
  • Personal data is handled according to our Privacy Policy, in accordance with the Icelandic Act on Data Protection and the GDPR.
  • We only collect and retain the data necessary to fulfil your booking and communicate with you.

12. Governing Law and Jurisdiction
  • These Terms and Conditions are governed by Icelandic law.
  • Any disputes shall be settled before the District Court of Reykjavík, unless otherwise agreed or required by applicable consumer protection laws.
